Terms of Service

Session Fee

The session fee secures the time and services of English Photoworks for the sitting and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by English Photoworks due to cancellation. Sittings that are postponed to a later date will retain the fee as long as English Photoworks can re-schedule for the new date and time.

Payments

Following payment of the session fee, balance of any fees due are to be paid on, or before the date of the sitting. No photographs will be delivered until all payments due have been paid in full. Payment for additional images and products is to be made when they are ordered.

Workshops

Our workshops are small-scale events with high overheads, so we generally cannot offer refunds if you cancel. If we are able to re-sell a booked place, we can issue a refund. In the event that you need to cancel your registration, please notify us as soon as possible so that we can offer your space to another participant. In exceptional circumstances it may be necessary to change the model at a workshop: should this be the case we will inform attendees. Covid-19: we are operating workshops in accordance with current government guidelines. In the event of a lockdown preventing a workshop from taking place, it will be rescheduled to the earliest mutually agreed date.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this agreement without the permission of English Photoworks in writing. Our digital products, including Masterclass, are for the sole use of the purchaser. They may not be copied, redistributed or shared.

Force Majeure

The due performance of this agreement is subject to alteration or cancellation by either party owing to any cause beyond their control.

Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this agreement by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the agreement. Neither party shall be liable for indirect or consequential loss. English Photoworks takes the utmost care with respect to exposure, transportation and processing of photographs, including using professional grade equipment and professional grade back-up equipment. However in the unlikely event of the client's photographs being lost, stolen, or destroyed for reasons within or beyond the control of English Photoworks, the latter's liability is limited to the return of all payments received for the package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a pro-rata amount of the exposures lost based on the percentage of total number of originals.

Cancellation

The Client may cancel this agreement at any time by giving written notice to English Photoworks but in doing so shall forfeit any monies paid. All cancellations must be in writing.

Negatives/Digital Files

All negatives/digital files remain the property of English Photoworks.

Performance

The performance of this agreement on behalf of English Photoworks shall be contingent upon force majeure, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

Personal Cameras

Personal cameras are not allowed in studio/on location during your photography session. Please refrain from taking iPhone images or video recording. We work very hard to ensure your session is captured artistically and creatively. We ask that you respect our livelihood and refrain from taking photographs of what we are creating.

Applicable Law

This agreement shall be governed by the Laws of England and Wales.

Variation

These Terms of Service shall not be varied except by agreement in writing.
